Right of withdrawal

Consumers have the right to withdraw from a distance contract within 14 days without giving a reason. The period starts when the Buyer, or a third party designated by the Buyer other than the carrier, receives the goods. If one order contains several goods delivered separately, the period starts when the last item is received.

To exercise this right, the Buyer must send SIA DEFSET an unequivocal statement before the 14-day period expires. The notice or withdrawal form may be sent to hello@defset.eu or to SIA DEFSET, Krišjāņa Barona iela 130 k-7, Riga, LV-1012, Latvia. The model withdrawal form appears at the end of this policy. Using the form is optional.

Returning goods

The Buyer must return the goods to SIA DEFSET at the address above without undue delay and no later than 14 days after sending the withdrawal notice. The deadline is met if the goods are dispatched before the 14-day period expires.

The Buyer bears the direct cost of returning the goods unless SIA DEFSET agrees otherwise or has not informed the Buyer of that obligation before the purchase. DEFSET does not offer exchanges; an unwanted eligible item should be returned and a new order placed separately.

The Buyer is liable only for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Goods may be inspected as they could be in a physical shop. Missing original packaging does not by itself remove the right of withdrawal, but goods must be packed safely for transport and should, where possible, include all components and accessories.

Refunds

SIA DEFSET will refund all payments received from the Buyer, including the cost of the least expensive standard outbound delivery offered, without undue delay and no later than 14 days after receiving the withdrawal notice. Extra delivery costs resulting from the Buyer choosing a more expensive method are not refundable.

SIA DEFSET may withhold the refund until it receives the goods or evidence that they were sent back, whichever occurs first. The refund will use the original payment method unless the Buyer expressly agrees otherwise, and no refund fee will be charged.

Exceptions

The right of withdrawal does not apply where an applicable statutory exception exists, including goods made to the Buyer's specifications or clearly personalized; goods liable to deteriorate or expire rapidly; sealed goods unsuitable for return for health-protection or hygiene reasons after unsealing; unsealed sealed computer software, audio or video recordings; and digital content not supplied on a tangible medium after performance has begun with the required prior express consent and acknowledgement. An exception is applied only when the goods and circumstances meet the legal requirements.

Faulty or incorrect goods

Withdrawal rights do not limit the Buyer's statutory remedies for goods that do not conform to the contract. For damaged, incorrect or non-conforming goods, contact hello@defset.eu with the order number, a description and, where possible, photographs.
